How many kids can you watch without a license in California?

California does not count heads for the exemption, it counts families: you may care for the children of only one family in addition to your own children without a license, per Health and Safety Code 1596.792(d). Care by a relative is also outside licensing. Everything else that is regular paid care needs a Family Child Care Home license: a small home takes up to 8 children and a large home up to 14, on strict age mixes.

What changes this answer

One family means one family, not a headcount

The exemption in 1596.792(d) covers the children of a single family plus your own. Five siblings from one household fit; two children from two households do not.

Your children under 10 count toward licensed capacity

Both the small and large home age-mix tables include children under age 10 who live in the licensee's home. The exemption side does not depend on your own children at all.

Only regular care is licensable at all

Licensing attaches to regularly provided care for periods of less than 24 hours while parents are away. The statute also exempts no-pay parent co-ops up to 12 children, programs running one day a week for up to 4 hours, and care where parents stay on the premises, among others in 1596.792.

TrustLine is registration, not a license

License-exempt providers can register with TrustLine, California's background-check registry. It is voluntary for this purpose and it is not a child care license.

Can I babysit one family's four kids at my house without a license?

The exemption in Health and Safety Code 1596.792(d) covers a family child care home providing care for the children of only one family in addition to the operator's own children. It is written per family, with no separate headcount.

How many infants can a small family child care home take?

Under 22 CCR 102416.5(b): 4 infants if infants are all you take; or 6 children with at most 3 infants; or 8 children with at most 2 infants when the school-age conditions of HSC 1597.44 are met.

When can a small home go from 6 to 8 children?

Only if at least one child is enrolled in kindergarten or elementary school and a second child is at least 6 years old, no more than 2 infants are in care, every parent is notified, and the property owner consents in writing where the home is rented.

What does a large home need for 13 or 14 children?

A large family child care home runs up to 12 children with at most 4 infants, or up to 14 with at most 3 infants when 2 of the children are school-age, and it requires an assistant when more than 8 children are present.

What happens for operating without a license in California?

After a Notice of Operation in Violation of Law, continuing to operate draws a civil penalty of 200 dollars per day. The numbers above are the licensing thresholds that avoid that path.
